Design is part of how customers recognize you—the shape of a product, the way packaging looks on a shelf, a distinctive layout or color scheme. We help evaluate whether that “look” can function as trade dress or a design-oriented trademark, then build the right strategy to protect it: assessing distinctiveness and functionality, shaping evidence (use, advertising, “look-for” messaging), and choosing smart filings (2D/3D drawings, design marks, color claims) that align with your brand plan. When issues arise, we coordinate practical enforcement—marketplace takedowns, demand letters, and TTAB proceedings where appropriate—and align the approach with your broader trademark program. We don’t prosecute patents, but when a design-patent angle would add value, we can coordinate with your patent team or trusted partners.
